These Terms of Service ("Terms") govern your use of the Trifectly website (www.trifectly.com), the Trifectly web application (picks.trifectly.com), and the Trifectly mobile application (collectively, the "Service"), operated by ProductiveMinds LLC ("we," "us," or "Trifectly").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Trifectly provides AI-generated horse racing analysis, picks, and handicapping intelligence. The Service is an informational tool designed to assist your own handicapping decisions.
Trifectly does not provide gambling advice, betting recommendations, or wagering services. All analysis, picks, tier rankings, and ratings are informational content generated by AI models. They reflect statistical patterns and analytical conclusions — not instructions to place wagers.
You are solely responsible for your own wagering decisions. We do not guarantee the accuracy of any pick, rating, or analysis. Past performance metrics published on the Service are historical and do not guarantee future results.
If you choose to wager based on information from the Service, you do so at your own risk and must comply with all applicable gambling laws in your jurisdiction.
You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials. You may not share your account or allow others to access the Service through your account.
We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are used for unauthorized purposes.
Access to racecards and picks requires credits. Credits are purchased through the Service and processed by Stripe. All purchases are final and non-refundable, except as required by law.
Credits do not expire. We reserve the right to change credit pricing at any time. Price changes do not affect credits you have already purchased.
New accounts receive complimentary credits as part of the sign-up offer. We reserve the right to modify or discontinue the sign-up offer at any time.

All content on the Service — including AI-generated analysis, picks, ratings, track profiles, research findings, statistical models, and user interface design — is the property of ProductiveMinds LLC and is protected by copyright and other intellectual property laws.
You may use content from the Service for your personal, non-commercial handicapping purposes. You may not reproduce, distribute, or publicly display our content without written permission.
Trifectly's analysis is built on publicly available racing data (race entries, official charts, results) combined with our own proprietary models and AI systems. All speed figures, pace projections, class ratings, pedigree analytics, and other derived metrics are computed by Trifectly. We do not resell or display third-party proprietary ratings.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ANALYSIS OR PICK WILL BE ACCURATE.
HORSE RACING OUTCOMES ARE INHERENTLY UNPREDICTABLE. NO AI MODEL, STATISTICAL SYSTEM, OR HANDICAPPING METHOD CAN GUARANTEE WINNING SELECTIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTIVEMINDS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR GAMBLING LOSSES, ARISING OUT OF YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless ProductiveMinds LLC, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your wagering activities.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in New York.
